اعتمدت الهيئة العامة للأوقاف اليوم لائحة تنظيم أعمال النظارة، الهادفة إلى ضبط أعمال النظارة وتنظيمها بما يحقق مقصد الواقفين ويعزز الدور التنموي للقطاع الوقفي.
حيث مرّت رحلة اعتماد اللائحة بمراحل متعددة بدأت بالتقييم ودراسة الوضع الراهن للاحتياجات والأولويات وآليات حوكمة الجهات الإشرافية على القطاع الوقفي وغير الربحي في الدول الإسلامية والمتقدمة، ليتم الانتقال إلى مرحلة التصميم عبر صياغة مسودة اللائحة واستطلاع مرئيات العموم وعقد ورش عمل مع المتخصصين والمهتمين لرصد ملاحظاتهم وآرائهم، فيما سيتم في المرحلة القادمة عقد لقاءات توعوية عن متطلبات اللائحة مع تصميم برامج تدريبية موجّهة للنظّار والعاملين في القطاع الوقفي.
وتهدف اللائحة التي نشرتها الهيئة عبر موقعها الإلكتروني إلى حماية أصول الأوقاف وتنميتها واستدامتها، وضمان تنفيذ شروط الواقفين، وتعزيز مبادئ الشفافية والإفصاح وترشيد الحوكمة، وتحسين الأداء والحث على تطوير السياسات والإجراءات، مما يسهم في تعظيم الأثر الاقتصادي والاجتماعي والتنموي للقطاع الوقفي، وخلق فرص وظيفية جاذبة لمزاولة أعمال النظارة.
وتأتي لائحة تنظيم أعمال النظارة في إطار سعي الهيئة نحو تحقيق أهدافها الاستراتيجية في تمكين القطاع الوقفي بجميع مكوناته ومن ذلك رفع مستوى الحوكمة وتعزيز الرقابة والشفافية وتطوير البيئة التشريعية للقطاع، للنهوض به وتعزيز مكانة الأوقاف والمحافظة عليها وتنميتها وفق رؤية المملكة 2030.
يذكر بأن نظـــام الهيئة العامة للأوقـــاف الصادر بموجب المرســـوم الملكي رقم م/11 وتاريـــخ 1437/02/26 َّ هـ، جاء في المادة الرابعة بأن الهيئـــة تشـــرف على جميع الأوقـــاف العامة، والخاصـــة (الأهلية)، ً والمشـــتركة، والفقرة (5 )من المادة (الخامسة) من النظام، " الإشراف على أعمال النظار الذين يعينهـــم الواقفون في حدود ما تقضي به الأنظمة، وبما لا يخالف شروط الواقفين، أو يدخل في أعمال النظارة."
